TERMS AND CONDITIONS OF SALE

1. Interpretation

In these Terms and Conditions ( Terms ), the following words and phrases shall have the following meanings: “the Buyer” means the person, firm or company who purchases the service from the Company:“the Company” means Undo Dents Ltd “Contract” means the contract between the Company and the Buyer which shall be deemed to incorporate these Terms; “service” means any repairs or additional services or products supplied by the Company to the Buyer; “Place of Delivery” means the place to which the service is to be delivered.In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time-to-time.

2. The Contract

The Contract shall be on these Terms to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the Buyer.
No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract.

3. Delivery

Repairs are completed following estimations / official quotation for repair. We endeavour to complete the repairs within a timeframe suitable for both parties. This typically is usually no more than 14 days of initial official quotation being delivered by the company to the buyer.
The Company will advise the Buyer if these timescales should need to change for any reason. Unless otherwise agreed in writing, the Place of Delivery shall be the agreed premesis in which originally requested by the customer . Any dates specified by the Company for delivery of the services are intended to be an estimate only. Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct or consequential, economic or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the services.

4. Cancellation

The Buyer has the right to cancel a booked service repair with us no less than 48 hours of the agreed repair date. If the buyer wishes to cancel, 48 hours notice minimum is required, failure to do so will lead to a cancellation fee of £50.

5. Price

The price quoted for any repair is used as a guideline until the damage is seen in person by the company. The amount quoted on any repair over digital communication should not be taken to be the confirmed exact price. The buyer will be made aware of any changes in price upon arrival, as well as the time frame and expectation for repair quality, before any repairs have commenced.

6. Payment

Subject to paragraph 5, payment of the price of the service shall be at the time of completion or if agreed by the Company in advance, due no later than 30 days from the date of the Company’s invoice for the service.
Payment shall not be deemed to have taken place until the receipt by the Company of cleared funds.
Payment can be made using all major Credit & Debit cards, Apple Pay, Android Pay, Bank Transfer and cash. We do not accept cheques unless they are cleared before repairs commence.

7. Repairs

We undertake to carry out the repairs indicated on the Quotation. If we decide that a particular class of dent may not be removable to our normal standards, we shall notify you in advance.

We understand that this can sometimes lead to disappointment, however We would rather only complete a repair if we are 100% sure we can get your vehicle back to pre damage state, unless You advise us that you still wish to proceed with the repair, knowing the finish will not be 100%

We reserve the right to decline to proceed with any process that would require further work to be completed outside the scope of the original schedule of repair work. In these circumstances the full Quotation price remains payable by the customer. Further work that does not increase the Quotation price may be proceeded with without the requirement for customer authorisation.

We aim to repair the damaged vehicle back to pre damage standard and we discharge our obligations under any repair agreement by providing a high quality, hand-completed dent removal. In normal circumstances, such a repair is very unlikely to be detected by a casual examination of the vehicle by an untrained observer unaware of the previous damage location.

It is the absolute responsibility of the customer to advise Us by way of images or video, any vehicle damage they wish us to assess for the purposes of providing a fixed price quotation.

It is also the absolute responsibility of the customer to advise Us, of any non-original parts on the vehicle that would hinder a repair. In case of incompatibility with a non-original part (whether or not notified by the customer), We have the right to void this contract in these circumstances, We will not be obliged to complete or rectify any repair and We have the absolute discretion to refuse any liability in relation to the Quotation that You accepted.

8. Warranties & Returns

Once a dent repair has been completed, the repaired area will be back to pre damaged state and you would continue to maintain your vehicle’s bodywork as normal. It is not possible for the dent to repair without further damage being sustained. As a result, no warranty is offered for the services provided.

9. Limitation of Liability

The Company’s liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed £100.00 and the Company shall under no circumstances be liable to the Buyer for any consequential, indirect or economic loss or damages.

10. General

If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms which will otherwise remain in full force and effect.

These Terms shall be governed by and interpreted according to English Law and the parties submit to the exclusive jurisdiction of the English Courts.
